TERMS AND CONDITIONS FOR SERVICES AND PRODUCTS OFFERED BY SHAMANIC PATH Oy

 

The following terms and conditions shall be applied for all services and products offered and delivered during all seasons by Shamanic Path Oy, the owner company of Shamanic Brew brand name, food producer and handicraft shop (hereinafter referred to as Shamanic Path), in Perttula, Finland, and any other area where the services are delivered.

1. DEFINITIONS

“Shamanic Path”, as specified in the Offer or Order Confirmation of all Shamanic Path Products, is the following company and property located in the following address: Shamanic Path Oy, business ID 3204038-1; address: Louhoksentie 63, 01860, Perttula, Finland.

“Consumer” is a natural or legal person, who has delivered the Order.

“Order” is any documentation in written form, from the Consumer to Shamanic Path to make a purchase.

“Order Confirmation” is any documentation from Shamanic Path to the Consumer including prices and specifications of the Products and confirming their availability.

“Products” are items offered by Shamanic Path.

2. SERVICES AND PRICES

The Products offered and to be delivered by Shamanic Path under these Terms and Conditions, and the according prices, are set out on the webpage shamanicpath.fi and on other online platforms linked with this web page. The given prices include VAT according to the Taxation Laws and Regulations of Finland. Shamanic Path reserves the right to change the prices for Products and Services which have not been paid yet for by the Consumer in case of any unforeseen increases in costs (including but not limited to taxes, fuel prices etc.) beyond the control of Shamanic Path.

3. RETURN AND REFUND OF PRODUCTS

If the Consumer is not satisfied with his/her Product, Shamanic Path will accept a return of an unused Product within 14 days after the date of its purchase. Once Shamanic Path receives the returned Product, Shamanic Path will then give a full refund (excluding shipping costs if the item was shipped).

The return will be processed within 14 working days from the moment when the item to be returned arrives at Shamanic Path.

Discounted Products, personalised Products (e.g. with a customised writing), food and drinks are not eligible for a return.

Shamanic Path will not issue refunds for Products purchased through other entities, such as distributors or retail partners.

Returned Products must be delivered to Shamanic Path unused, in original packaging and in the condition they were received. If this condition is not fulfilled may not be eligible for refund or be subject to a restocking fee. Shamanic Path cannot be held responsible for items damaged or lost in return shipment, therefore insured and trackable mail service is recommended.

Shamanic Path is unable to issue a refund without actual receipt of the Product(s) or proof of received return delivery.

All goods will be inspected on return. In the unlikely event that an item is returned to Shamanic Path in an unsuitable condition, Shamanic Path may have to send it back to the Consumer at the Consumer’s expenses.

A defective or damaged Product can be replaced by Shamanic Path. In this case the costs for the shipping by the Consumer to Shamanic Path will be refunded by Shamanic Path.

With the exception of defective or damaged Products, the Consumer pays the shipping costs for returning an item to Shamanic Path. Shipping costs are non-refundable.

4. LIABILITY

Shamanic Path shall exercise pro-activity, contingency, due diligence and appropriate health and safety measures in accordance with the laws and regulations of Finland at all times when delivering offered goods under these terms and conditions.

 

Shamanic Path is not liable for any accidental damage or injury which is not caused by negligence of Shamanic Path or its employees or by the provision of faulty equipment. The Consumer agrees that she/he handles the products that are burning received from Shamanic Path exclusively at his/her own risk. Shamanic Path is not responsible for the possible damage from candle burning in case of fire hazard. 

 

5. FORCE MAJEURE

Neither Party shall be held liable for any default, damage or loss due to a condition force majeure or to unreasonable impairment of the Party’s operations due to a similar cause (including but not limited to war, strike, weather, lack of snow, or other natural condition etc.). If encountered a force majeure condition, the Party shall immediately notify the other Party in writing thereof, and shall keep the other Party fully informed of the continuance of the force majeure condition and of any relevant change of circumstances whilst such force majeure continues. When encountered a force majeure conditions Parties shall also take all reasonable steps available to it to minimize the effects of the force majeure on the performance of their obligations under this contractual relationship.

6. APPLICABLE LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with the Finnish Law. The Finnish Courts shall have the exclusive jurisdiction to settle any dispute, controversy or claim related to such a demand. The District Court of Lapland (in Finnish: Lapin Käräjäoikeus), placed in Rovaniemi, shall be the court of first instance.

7. SEVERABILITY

If any part, term or provision of these terms and conditions is partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.
